Brooklyn Judge Follows Arizona and Texas Cases; Denies Motion to Dismiss in Maverick v. Goldshteyn

Judge Trager in Brooklyn federal court has followed the decisions of the district courts in Arizona and Texas, and denied defendant's motion to dismiss the complaint, in Maverick v. Goldshteyn.

It's quite remarkable in my experience for a judge to deny a motion to dismiss because he or she doesn't understand the facts. That would usually be irrelevant, or it would be a reason to grant the motion, since it was the plaintiffs' burden to make themselves understood.

For 4 judges to come to that same conclusion is, I think, incredible.
